New Jersey: NORML Lawyers File Constitutional Lawsuit Over State's
Failure To Implement Two-Year-Old Medical Cannabis Law

ニュージャージー州: 二年前に成立した薬用大麻法を州が施行していないとし
て NORML 所属弁護士が行政訴訟を起こす

Trenton, NJ: Members of the NORML Legal Committee filed suit yesterday
against the State of New Jersey over regulators' failure to implement
the Compassionate Use of Medical Marijuana Act.

ニュージャージー州トレントン: NORML 法務委員会は昨日、ニュージャージー
州当局が「恩情ある薬用大麻法」を施行していない事を理由に、州を相手取っ
て提訴した。

Signed into law by former Gov. Jon Corzine on January 18, 2010, the
law - which establishes the creation of up to six state-licensed
'alternative treatment centers' to provide medicinal cannabis to
qualified patients - was initially scheduled to take effect in July
2010. Since that time state regulators, at the behest of present
Gov. Chris Christie, have unduly delayed the law's implementation.

2010 年 1 月 18 日に前任の州知事ジョン・コージンの署名を以って成立した
法律、州内に六ヶ所までの「代替医療センター」を開設し、許可を得た患者に
薬用大麻を提供するという法律は、本来ならば同年 7 月より施行される事になっ
ていた。しかしながら州当局は現州知事クリス・クリスティーの命令を受けて、
当時より法の施行を不当に延期したまま現在に至っている。

In the 27 months since the measure was signed into law, no treatment
centers have obtained the necessary licenses to open for business and
not a single patient in New Jersey has been afforded legal protections
under the Act.

この法案が成立してから既に 27 ヶ月が経過しているが、営利事業を行うに当っ
て必要な認可を得られた診療所は未だに一つも存在せず、またニュージャージー
州に住む患者のうちこの法律による法的保護を得られている者はただの一人も
居ない。

On Wednesday, April 4, NORML Legal Committee attorneys William
H. Buckman of Moorestown and Anne M. Davis of Brick filed a lawsuit on
behalf of a New Jersey medical patient who qualifies for cannabis
access under state law. The suit also represents a physician who has
registered with the state to recommend medical marijuana. Named in the
suit are the Department of Health and Senior Services (DHSS)
Commissioner Mary O'Dowd and the newly appointed director of the
Medicinal Marijuana Program John O'Brien.

4 月 4 日水曜、NORML 法務委員会に所属するムーアズタウン行政区のウィリア
ム H. バックマン弁護士およびブリック行政区のアン M. デイヴィスは、ニュー
ジャージー州の法律の下で大麻を使用する為の許可を得たある患者の代理人と
して提訴した。またこの訴訟では州で薬用大麻の使用を推薦できるものとして
登録されたある医師をも代理している。訴状では保健社会福祉局 (DHSS) の局
長であるマリー・オダウド、および薬用大麻プログラムの新任責任者である
ジョーン・オブライアンが名指しされている。

Stated attorney Buckman in a press release, "Today we are filing suit
to require the DHHS to do what every other citizen must do - follow
the law."

バックマン弁護士はプレスリリースの中で次のように述べている。「本日我々
は、他の全ての市民が為さねばならぬ事を DHHS に対しても要求する為に、こ
れを相手取って提訴する。その義務とは法に従う事である。」

Added Davis: "Our neighbors with AIDS, cancer, multiple sclerosis and
the worst of medical conditions have testified before the legislature
and changed the law. Now, patients and doctors have to go to court to
win the rights that they should have already been afforded."

またデイヴィスは次のように付け加えた。「AIDS、癌、多発性硬化症、その他
最も深刻な健康状態にある我々の隣人は、議会にて証言を行い、そして法律を
改正した。ところが今や患者と医師は、既に与えられたはずの権利を勝ち取る
為に裁判所へ赴く羽目になっている。」

State-licensed medicinal cannabis dispensaries are presently
operational in Colorado, Maine, and New Mexico.

現在、州の認可を得て運営されている薬用大麻ディスペンザリーはコロラド州、
メーン州、ニューメキシコ州に存在する。
