California: Oakland City Council Approves Regulations For
First-In-The-Nation Industrial Marijuana Production Facilities

Oakland, CA: Oakland city council members last week approved
legislation authorizing the private, large-scale production of medical
marijuana by commercial providers.

カリフォルニア州オークランド: オークランド市議会は先週、民営による医療
大麻の営利的な大規模生産を認可するような条例案を可決した。

Under the measure, the city will license four production warehouses
where marijuana would be grown, packaged and processed for medical
use. The privately owned facilities would not be limited in
size. However, the regulations will require applicants to possess a
minimum of $3 million worth of insurance, hire security, and pay a
$211,000 annual permit fee to the city.

この条例では、医療用途としての大麻を栽培、後処理、梱包するための四ヶ所
の生産施設に対して市がライセンスを与える事になる。民間の保有する生産施
設は、その規模については制限されないが、ライセンスの申込者には最低 300
万ドルの保険に加入していること、警備員を確保すること、そして市に毎年
21 万 1 千ドルの認可手数料を支払う事が求められる。

Members of the city council said that they will vote this fall on
similar regulations to oversee the licensing of smaller size grow
operations.

市議会議員らは今週の秋にも、より小規模な生産事業者に与えるべきライセン
スと規制基準についての条例に対しても投票を行う予定である事を語った。

Voters in neighboring Berkeley will decide on a similar municipal
measure in November that seeks to license up to six area medical
marijuana production facilities.

今年の 11 月には隣のバークレー市でも六ヶ所の地域で医療大麻生産施設を認
可するための類似した条例案が審議される。

In a separate Oakland city council vote this week, members rejected a
proposal to tax medical marijuana cultivators and dispensaries –
instead electing to put the measure before voters this November.

市議会で今週採決された別の条例案、医療大麻の栽培者およびディスペンザリー
に課税するための条例案は否決された。代わりにその法案は今年 11 月に投票
に掛けられる事になった。

毎年の認可手数料が 1800 万円！ すごい手数料だ。しかしオランダでさえ未だ
に大麻の商業生産が（提案はされているが）合法になっていないこと、カリフォ
ルニア州は財政破綻の危機にあること、生産規模の上限が無いこと、そして見
込まれる需要を考えれば、あながち法外な料金とも言えまい。小規模農家の扱
いがどうなるのかに注目しよう。
