U.S. DEA Finally Gets Its Man September 29th, 2009 By: Paul Armentano, NORML Deputy Director いよいよ合衆国麻薬取締局はホシを挙げる 2009 年 9 月 21 日、NORML 副事務局長ポール・アルメンターノ Just over four years ago, former U.S. DEA administrator Karen Tandy announced to the world that her agency had struck "a significant blow … to the marijuana legalization movement" by indicting Canada's so-called 'Prince of Pot,' Marc Emery. 四年以上も前、かつての合衆国麻薬取締局長カレン・タンディーは、世界へ向 けて次のように宣言した。麻薬取締局は、通称『大麻王子』、カナダ人のマー ク・エメリーを起訴する事により「大麻合法化運動に大きな打撃を与えた」と。 For nearly two decades Emery operated a successful marijuana seed bank operation in Vancouver, British Columbia — a venture which he used to directly fund cannabis law reform efforts around the globe, including the magazine Cannabis Culture, the internet site Pot TV, and the founding of the British Columbia Marijuana Party. 20 年近くもの間、バンクーバー、ブリティッシュ・コロンビア州でエメリーは 大麻種子バンクを運営し、成功していた。彼は雑誌『Cannabis Culture（大麻 文化）』やインターネット放送『Pot TV』を含む世界中の大麻関連法改正運動 組織を直接立ち上げ、ブリティッシュ・コロンビア大麻党を設立した。 Emery's seed business was hardly a secret. For many years, Emery mailed copies of his seed catalogue to Canadian politicians. A Canadian court convicted him in 1998 and sentenced him to a $2,000 fine. Undeterred, Emery continued to sell seeds — and pay federal taxes on his profits — up until his arrest. Canadian authorities were happy to accept his tax money, and officials at Health Canada, which oversees Canada's legal medical marijuana program, often recommended that patients contact Emery for grow advice. Once here, he faces up to five years in prison for pleading guilty to one count of conspiracy to manufacture marijuana (more than 100 plants) in violation of 21 USC 841(a)(1) and 841(b)(1)(B). エメリーの有罪は明らかであったにもかかわらず、アメリカ合衆国へ身柄を引 き渡すため、カナダの行政局は最長一ヶ月間、彼を国内の留置所に収監した。 彼は大麻製造を謀議した容疑（100 株以上）について有罪答弁を行ったため、 五年間の服役を言い渡された。21 USC 841(a)(1) および 841(b)(1)(B) の違反 によってである。 But lets not kid ourselves. Marc Emery was hardly a high level target because he sold marijuana seeds to the U.S. — a simple google search will yield dozens of listings of competitors that presently engage in similar activities. No, it wasn't so much what Marc did ("There isn't a single victim in my case, no one who can stand up and say, 'I was hurt by Marc Emery.' No one," he told the Vancouver Sun) as it was what he did with his money that aroused the ire of U.S. anti-drug officials. しかし、ごまかしてはならない。大麻の種をアメリカに売ったからといって、 マーク・エメリーは重大な被疑者であるとは言えない。単純に Google で検索 しただけでも、似たような活動に従事している競争業者は大量に見付かるので ある。彼は Vancouver Sun 紙に次のように語った。「私に関してはたった一人 の被害者も存在しない。誰も、立ち上がって『私はマーク・エメリーに傷付け られました』と言う事のできる者は居ないのだ。誰もだ」。彼のした事は、自 分の資金で、アメリカの反ドラッグ派の役人達を怒らせた事だけだ。 And we have Karen Tandy's own words to prove it. その事は、カレン・タンディー自身の言葉が証明しているのである。 [私のコメント] マーク・エメリーが逮捕されたのは 2005 年であるとの事で、この記事からは、 現在の状況がどうなっているのかは良く判らない。 私はマーク・エメリーの米国への引き渡しに強く反対する。米国の麻薬取締局 は「大麻合法化運動に大きな打撃を与える」ために彼を起訴したのだ。これは 政治犯や思想犯としての扱いである。大麻合法化運動は思想犯罪。それが彼ら のメッセージに他ならない。実際、彼の言う通り被害者など唯の一人も居ない のである。 この捉え方は大麻に限らず全ての「被害者なき犯罪」に拡張する事ができる。 すなわち、売春は思想犯罪の一種である。賭博、武器の所持、ポルノの製造販 売、国によっては同性愛までも思想犯罪だ。21 世紀にもなってこの世界の国々 は思想犯罪者を取り締まっているのだ。馬鹿馬鹿しい。 カナダとアメリカの政治的な関係が対等のものでない事は（良く知らないまで も）想像の付く事ではあるが、カナダ政府は外国から政治犯として起訴された 自国民を引き渡すほどに腰抜けなのだろうか。既に四年も拒んで来たのだろう。 腰抜けではないと信じたい。
